Terms of Service

1. Acceptance of Terms
By accessing or using CREstimate.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not access or use the Service.
These Terms constitute a legally binding agreement between you (or the organization you represent) and CREstimate, LLC ("Company," "we," "us," or "our"). If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
2. Description of Services
CREstimate.ai is a commercial real estate intelligence platform that provides:
- CRESI Reports — AI-generated market intelligence reports that score multifamily markets using macroeconomic, demographic, capital market, and current event signals.
- Property Lookups — Automated retrieval of property details, tax records, rental listings, and occupancy data via browser automation.
- Acquisition Proforma — An interactive financial modeling tool for multifamily property acquisitions.
- Document Parsing — Extraction of structured financial data from uploaded rent rolls, operating statements, and offering memoranda.
The Service is available on a subscription basis (Free, Pro, and Enterprise tiers) as further described in Section 4.
3. Account Registration
To access protected features you must create an account. You agree to:
- Provide accurate and complete registration information.
- Keep your password secure and not share it with third parties.
- Notify us immediately at [email protected] of any unauthorized account access.
- Accept responsibility for all activity that occurs under your account.
You must be at least 18 years old to create an account. We reserve the right to refuse registration or cancel accounts at our discretion.
4. Subscription Plans, Billing & Payment
4.1 Plans
We offer Free, Pro ($99/month or $948/year), and Enterprise (custom pricing) plans. Current plan limits and features are listed on the Pricing page. We may change plan pricing with 30 days' notice to current subscribers.
4.2 Billing
Payments are processed by Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring basis. You agree to Stripe's Services Agreement. All fees are in USD and are non-refundable except as stated in Section 4.5.
4.3 Usage Limits
Each plan includes monthly usage quotas (e.g., number of CRESI reports). Quotas reset on the first day of each calendar month. Unused quota does not roll over. If you exceed your plan's limits, additional usage requires a plan upgrade.
4.4 Free Trial
New Pro subscribers receive a 14-day free trial. You will not be charged until the trial period ends. You may cancel before the trial ends to avoid charges. Only one free trial per person or organization is permitted.
4.5 Refunds
You may request a full refund within 48 hours of your first paid charge by contacting [email protected]. After 48 hours, charges are non-refundable.
4.6 Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access through that date. We do not prorate partial months.
4.7 Failed Payments
If a payment fails, we will retry up to three times over seven days. During this period you retain full access. If all retries fail, your subscription downgrades to the Free plan and your saved reports are preserved but inaccessible until you resubscribe.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws.
- Reverse-engineer, decompile, or attempt to extract source code or model weights from the Service.
- Resell, sublicense, or commercially redistribute outputs without our written consent.
- Scrape, crawl, or use automated means to bulk-extract data beyond normal API usage.
- Upload malicious files or attempt to circumvent security measures.
- Impersonate another person or misrepresent your affiliation with any entity.
- Use the Service to conduct due diligence on behalf of investors without disclosing that AI-generated analysis was a primary source.
We reserve the right to suspend or terminate accounts that violate these restrictions without notice or refund.
6. No Investment or Financial Advice
CRESI reports, proforma analyses, property valuations, and all other outputs from the Service are for informational purposes only. Nothing in the Service constitutes investment advice, financial advice, legal advice, or a recommendation to buy, sell, or hold any security, real property, or financial instrument.
Commercial real estate investment involves significant risks including loss of principal. Past market conditions are not indicative of future results. AI-generated analysis may contain errors, omissions, or hallucinations. You should consult licensed brokers, appraisers, attorneys, and financial advisors before making any investment decision.
CREstimate.ai is not a licensed real estate broker, investment adviser, or appraisal firm. Our CRESI scores and valuations are algorithmic estimates derived from public data and should not be used as the sole basis for any transaction.
7. Intellectual Property
7.1 Our Property
The Service and its original content (excluding user-uploaded documents), features, functionality, brand, models, and algorithms are the exclusive property of CREstimate, LLC and its licensors. The Service is protected by copyright, trademark, and other laws.
7.2 Your Content
You retain ownership of documents you upload for parsing. By uploading content, you grant us a limited, non-exclusive license to process that content solely to provide the Service to you. We do not use your uploaded documents to train our models.
7.3 Report Outputs
CRESI reports and proforma outputs generated for your account are licensed to you for internal business use. You may share individual reports with clients, lenders, or partners. You may not resell report outputs as a standalone product or incorporate them into competing services.
8. Data & Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated by reference into these Terms. The Privacy Policy explains how we collect, use, and share information when you use the Service.
We use Supabase for authentication and database storage, Stripe for payment processing, and Resend for transactional emails. Your data is stored in the United States. By using the Service, you consent to this processing.
9. Third-Party Services
The Service integrates with or relies on third-party data sources including the U.S. Census Bureau, Federal Reserve (FRED), Bureau of Labor Statistics, Zillow, Realtor.com, GDELT, FDIC, and others. These sources may have their own terms of use. We make no warranty regarding the accuracy, completeness, or timeliness of third-party data.
Property lookups use browser automation that navigates public websites (county tax assessors, listing platforms). These lookups are subject to the terms of those third-party sites. We do not guarantee the availability or accuracy of data retrieved from third-party websites.
10. Disclaimers of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AI-GENERATED CONTENT MAY BE INACCURATE, INCOMPLETE, OR OUTDATED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRESTIMATE, LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify, defend, and hold harmless CREstimate, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your uploaded content, or (d) any investment or business decision you made based on outputs from the Service.
13. Termination
We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms or engage in conduct we determine to be harmful to the Service or other users. Upon termination, your right to use the Service ceases. Sections 6, 7, 10, 11, 12, 14, and 15 survive termination.
You may close your account at any time from your account settings. We will delete your personal data within 30 days per our Privacy Policy, except where retention is required by law or legitimate business interests.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia for any disputes.
Before filing any formal legal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
15. Changes to These Terms
We may revise these Terms at any time. When we make material changes, we will update the "Last updated" date above and send an email to registered users at least 7 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
If you disagree with any changes, your sole remedy is to stop using the Service and cancel your subscription before the new Terms take effect.
